Vietnam - Circular No 32/2017/TT-BCT published
On 28 December 2017, MOIT published a ministerial circular named Circular No 32/2017/TT-BCT to assist the implementation of the Decree No 113/2017. The Circular took effect immediately.
Key points are as follows:
- Guidance on compiling chemical safety data sheet;
- 19 forms used by business operators and individuals in the chemical-related field issued in the Annexes;
- Setting out plans and measures to prevent and respond to chemical incidents in the industrial field;
- Classification and labeling of chemicals;
- Declaration of imported chemicals.
However, there are transitional provisions for business operators and ndividuals that have been granted the certificates or permits by the competent agencies before the effective date of Decree No. 113/2017/ND-CP shall continue their operation until their licenses or certificates expire. Chemicals already classified or labelled for the market can circulate until their expiry date. Certificates and permits approved by competent agencies before the Decree, will apply until expiry.
Business operators and individuals using industrial chemicals, subject to conditional or restricted production and trading under the new Decree must provide a supplemental application for certificates and permits before 28 June. This does not apply to substances listed in Annex 1 of circular 28/2010/TT-BCT or Annex 2 of Decree No 26/2011/ND-CP.
Business operators and individuals shall review the Decree 113/2017/ND-CP and the Circular No. 32/2017/TT-BCT to determine if permits, licenses, or reports will be required to support chemical activity in Vietnam. It is important to review the new requirements for SDSs, labels and the revised classification of chemicals to ensure that their products comply with the various changes and requirements.
