Vietnam - Amendments to Decree No. 113/2017/ND-CP

Vietnam published a draft with amendments to Decree No. 113/2017/ND-CP

The Ministry of Industry and Trade (MOIT) released a draft decree (note: the page is in Vietnamese) to amend the Decree 113/2017/ND-CP on the details of the Law on Chemicals.

The amendment are as follows:

  • Addition of 12 substances as banned chemicals
    12 substances regulated by the Chemical Weapons Convention (Schedule 1 A (No. 13 to 16) will be added to the list of banned chemicals of Annex III.
     
  • Addition of restricted chemicals
    The following 6 substances regulated by the Stockholm Convention will be added to the list of restricted chemicals of Annex IV:
  1. Hexabromocyclododecane,
  2. Chlordecone,
  3. Pentachlorobenzene (PeCB),
  4. Polychlorinated naphthalene (PCN)
  5. Decabromodiphenyl ether (DBDE),
  6. Perfluorooctanoic acid (PFOA) and its salts
  • Nitrous oxide, cyanide, mercury and mercury compounds will be designated as chemicals subject to special control at the time of import.
    After these chemicals are declared for import, the Ministry of Industry and Trade (MOIT) will determine their compliance and notify the results. The annual import volume will be taken into account in the determination.
     
  • Having the < 0.1% concentration cut-off value for conditional chemicals, restricted chemicals, and chemicals subject to be declared.
     
  • Change in annual reporting deadlines for chemical activities to 15th February.
     
  • Changes in GHS classification categories. Classification of chemicals is done according to GHS rules and technical guidelines from GHS Revision 2 (2007) onwards. GHS version 2 includes the main classifications as in Appendix I to this draft Decree.
