EC published amendment on Food Additive Regulation No 1333/2008

The European Commission published on June 29th ,2023 the Amendment to Annex II of Regulation (EC) No 1333/2008 for the use of the food additive polyglycerol polyricinoleate (E 476) and the Amendment to Regulation (EU) No 231/2012 with respect to specifications for glycerol (E 422), polyglycerol esters of fatty acids (E 475) and polyglycerol polyricinoleate (E 476).

Food additive polyglycerol polyricinoleate (E 476): This additive can be used in food category 03 edible ices with a maximum level of 4000 mg/l or mg/kg (except for sorbets).

In food category 12.6 Sauces, E476 can be used at a maximum level of 4000 mg/l or mg/kg only for emulsified sauces with a fat content of less than 20 % and with a maximum content of 8000 mg/l or mg/kg for emulsified sauces with a fat content of 20 % or more.

Specifications for food additives E 422 (glycerol), E 475 (polyglycerol esters of fatty acids) and E 476 (polyglycerol polyricinoleate):  The level of some heavy metals (i.e., arsenic, lead, mercury and cadmium) has been lowered: For instance, the limit for Arsenic has changed  from being no more than 3 mg/kg to being no more than 0.1 mg/kg.

In addition, the sum of 3- monochloropropanediol (3-MCPD) and 3-MCPD fatty acid esters (expressed as 3-MCPD) has been updated.

Food additives E 422, E 475 and E 476 which are lawfully placed on the market before 20 July 2023 and do not comply with the introduced amendment are currently still allowed to be used in food, in compliance with Regulation (EC) No 1333/2008, until 20 January 2024.
