THAILAND - new rules for List 5.6 declaration criteria & procedure

Thailand published the Notification of Ministry of Industry (MOI) on Declaration of the Production or Import of Hazardous Substances of Annex 5.6 under Responsibility of the DIW B.E. 2565 (2022) which will come into force on 26 September 2022.

Currently, enterprises handling Annex 5.6 hazardous substances shall declare manufacture/import information to the DIW within 60 days since the date when they produce or import such substances in quantities exceeding 1,000 kg per year on a product basis via the DIW’s online system (WoAo/AoKo 20). According to this new MOI Notification, enterprises handling Annex 5.6 hazardous substances (substances or mixtures) which have the total amount of the single substance in all products > 1,000 kg/year must provide the information in compliance with the form “WoAo/AoKo 32”. The information on the SDS such as: GHS classification, details of the applications the substance will be used for (consumer use, commercial use, industrial use, and intermediate or non-isolated intermediate), and the total amount of each substance in all products per year shall be declared. After the notification is in force, the enterprises are required to declare the above information of the previous calendar year before 30 June of the following year.
