US EPA Publishes Final Rule On TSCA Fees

What’s Happening?

The Environmental Protection Agency (EPA) released a final fees rule under the Toxic Substance Control Act (TSCA) on September 27, 2018.  The final rule was effective the day after publication and the fees will be applied to all submissions received starting on October 1, 2018.  The fee for the submission of a Premanufacture Notice (PMN) is going to be increased from $2500 to $16,000 and the fee for the submission of a Low Volume Exemption (LVE) will be increased from $0 to $4700. 

Small businesses will be eligible for substantial discounts on their fees.

The Agency will subsequently adjust fees, as necessary, every three years to reflect inflation and ensure that the receipts are sufficient to cover 25% of the costs to carry out the activities specified in TSCA section 26(b) as well as 50% or 100% of the costs of risk evaluations requested by manufacturers, depending on the chemical.
