New draft EU Regulation for recycled plastic food contact materials

A draft regulation was published by the European Commission intended to replace Regulation (EC) No 282/2008.

On 06 December 2021, the European Commission has published a draft regulation for public consultation that is intended to replace Regulation (EC) No 282/2008. Industry and key stakeholders are now invited to provide feedback on the draft regulation. Feedback can be submitted until midnight on 10 January 2022.

 

In summary, the new regulation indicates that:

  • All materials brought in contact with food must be safe, and therefore not contain any toxic contaminants
  • The European Union (EU) rules require individual authorisations for plastic recycling processes

Furthermore, the new (draft) regulation sets out:

  • Transitional provisions
  • Definitions for a recycling technology and a recycling process, and many other key terminologies
  • Provisions for the appropriate evaluation of non-PET materials (i.e. without polyethylene terephthalate)
  • Clear obligations for business operators and competent authorities
